TriedThat Terms of Service

These Terms of Service ("Terms") govern your access to and use of TriedThat, a mobile application operated by Lashachi Inc., a Canadian company ("Lashachi," "we," "us," or "our").By accessing or using TriedThat, you agree to these Terms. If you do not agree to these Terms, do not use TriedThat.Please read these Terms together with the TriedThat Privacy Policy, which explains how information is handled when you use the app.
1. About TriedThat
TriedThat is a private memory application designed to help you remember things you have tried and whether you would choose them again.TriedThat may allow you to create, organize, store, and retrieve memories about food and drink and related things you choose to record.Features and functionality may change as TriedThat develops.
2. Eligibility and Your Account
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. You must be legally capable of agreeing to these Terms under the laws that apply to you.Certain TriedThat features require an account. You agree to provide accurate information when creating or accessing your account and to keep access to your email account and devices secure.You are responsible for activity conducted through your TriedThat account.If you believe your account has been accessed without authorization, please contact Lashachi Inc. as soon as reasonably possible.
3. Free Accounts
TriedThat may provide a free version of the service.The current free account allows you to save up to three memories to your account.We may modify the features or limits of the free version in the future. If a change materially affects existing users, we will provide notice where reasonably appropriate or required by applicable law.Nothing in these Terms guarantees that any particular free feature or usage limit will remain available indefinitely.
4. TriedThat Solo
TriedThat may offer a paid subscription called TriedThat Solo.TriedThat Solo currently provides access to additional features, which may include unlimited saved memories and the ability to access account-based memories across supported devices.The specific features included with TriedThat Solo may evolve over time as the service develops.The price and billing period applicable to your purchase will be displayed through the applicable app marketplace before you confirm your subscription.
5. Subscriptions, Billing and Renewal
TriedThat Solo is offered as an automatically renewing annual subscription unless otherwise stated at the time of purchase.Your subscription is purchased and billed through the applicable app marketplace, such as Apple's App Store or Google Play.The applicable price will be displayed to you before you complete your purchase.Unless you cancel your subscription in accordance with the rules of the applicable app marketplace, your subscription may automatically renew for another billing period and the marketplace may charge your selected payment method.Lashachi Inc. does not directly process or store your full payment-card information for app-store purchases.
6. Managing and Cancelling Your Subscription
You can manage or cancel your TriedThat Solo subscription through the account settings provided by the app marketplace through which you purchased it.Deleting your TriedThat account or deleting the TriedThat app from your device does not necessarily cancel an active subscription.If you no longer want your subscription to renew, you are responsible for cancelling it through the applicable app marketplace before the renewal date.Cancellation generally prevents future renewal and does not necessarily terminate access that you have already paid for during the current subscription period, subject to the policies of the applicable app marketplace and applicable law.
7. Refunds
Purchases made through Apple's App Store or Google Play are subject to the billing, cancellation, and refund rules of the applicable marketplace.Refund requests for app-store purchases may need to be submitted directly to Apple or Google, as applicable.Nothing in these Terms limits any refund, cancellation, or other consumer right that cannot lawfully be excluded or limited.
8. Subscription Verification
TriedThat uses RevenueCat to help manage and verify subscription entitlements.Access to TriedThat Solo features may depend on confirmation that the applicable subscription entitlement is active.Temporary delays, app-store outages, network problems, account mismatches, or other technical issues may occasionally affect subscription verification or restoration.Where supported, TriedThat may provide functionality to restore eligible purchases associated with your applicable app-store account.
9. Your Memories and Content
You retain ownership of the information, notes, photos, and other content that you create or provide through TriedThat ("User Content").You give Lashachi Inc. a limited permission to host, store, process, reproduce, and transmit User Content only as reasonably necessary to operate, secure, maintain, and provide TriedThat to you.This permission does not transfer ownership of your User Content to Lashachi Inc.You are responsible for the User Content you choose to create or store and for ensuring that your use of that content does not violate applicable law or the rights of others.
10. Photos and Device-Stored Content
Certain TriedThat content may be stored locally on your device rather than on TriedThat's servers.In the current version of TriedThat, photos attached to memories are stored locally on your device.Locally stored information may not be available on another device and may be lost if you delete the app, erase or replace your device, clear application data, or otherwise remove the locally stored information.You are responsible for maintaining any separate copies or backups of locally stored content that are important to you.
11. Acceptable Use
You agree not to misuse TriedThat.You must not:• use TriedThat for unlawful, fraudulent, or abusive purposes;
• attempt to gain unauthorized access to TriedThat, another user's account, or related systems;
• interfere with or disrupt the operation or security of TriedThat;
• introduce malicious code or intentionally harmful material;
• attempt to circumvent usage limits, subscription controls, authentication, or security measures;
• use automated methods to access the service in a manner that places unreasonable demands on our systems; or
• use TriedThat in a way that violates applicable law or the rights of another person.We may take reasonable action to protect TriedThat, our users, and our systems from misuse or security threats.

Your use of TriedThat is also subject to the TriedThat Privacy Policy.The Privacy Policy explains how Lashachi Inc. collects, uses, stores, and otherwise handles information associated with TriedThat.The TriedThat Privacy Policy is available at:
13. Account Deletion
TriedThat provides functionality for requesting deletion of your account.Account deletion permanently removes or de-identifies account information and server-stored TriedThat data, except for information that Lashachi Inc. may be required or permitted to retain for legal, security, fraud-prevention, financial-recordkeeping, dispute-resolution, or other legitimate purposes.Content stored only on your device may need to be removed separately from that device.Deleting your TriedThat account does not necessarily cancel an active subscription. You should separately manage or cancel your subscription through the applicable app marketplace.
14. Availability and Changes to TriedThat
We aim to provide a reliable service, but we do not guarantee that TriedThat will always be available, uninterrupted, error-free, or compatible with every device or operating-system version.We may maintain, modify, add, remove, suspend, or discontinue features when reasonably necessary to operate, improve, secure, or develop TriedThat.We may also discontinue TriedThat as a service.Where reasonably practicable and appropriate, we will provide notice before a material change or discontinuation that significantly affects users. Any rights you have under applicable consumer law remain unaffected.
15. Third-Party Services
TriedThat relies on third-party platforms and service providers to provide certain functionality, including app distribution, infrastructure, authentication, communications, and subscription management.Your use of services provided directly by third parties, including Apple's App Store or Google Play, may also be governed by their own terms and policies.Lashachi Inc. is not responsible for third-party services to the extent that they are outside our reasonable control, subject to applicable law.
16. Intellectual Property
Except for User Content and third-party materials, TriedThat and its associated software, design, branding, graphics, text, interfaces, logos, and other materials are owned by or licensed to Lashachi Inc. and are protected by applicable intellectual-property laws.These Terms give you a limited, personal, non-exclusive, non-transferable, and revocable right to use TriedThat for its intended purpose.These Terms do not transfer ownership of TriedThat or Lashachi Inc.'s intellectual property to you.
17. Feedback
If you voluntarily provide suggestions, ideas, or feedback about TriedThat, you agree that Lashachi Inc. may use that feedback to develop, improve, or operate TriedThat without an obligation to compensate you.This does not give Lashachi Inc. ownership of your private memories or other User Content.
18. Suspension or Termination
You may stop using TriedThat at any time.We may restrict, suspend, or terminate access to TriedThat where reasonably necessary because of a material violation of these Terms, unlawful or abusive activity, security risks, or circumstances that make continued provision of the service impracticable.Where reasonably appropriate, we will attempt to provide notice before taking such action.Any rights or obligations that by their nature should continue after termination will survive termination, subject to applicable law.
19. Disclaimers
TriedThat is provided for personal information-management and memory purposes.To the extent permitted by applicable law, TriedThat is provided on an "as is" and "as available" basis. We do not guarantee that the service will always be uninterrupted, error-free, secure, or free from data loss.TriedThat is not intended to provide medical, legal, financial, nutritional, safety, or other professional advice. Information you record in TriedThat reflects your own entries and experiences.Nothing in these Terms excludes warranties, guarantees, conditions, or other rights that cannot lawfully be excluded under applicable consumer-protection law.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Lashachi Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of or inability to use TriedThat.To the extent permitted by applicable law, Lashachi Inc. is not responsible for loss of locally stored content resulting from circumstances such as device loss, device failure, application deletion, or removal of local application data.These limitations do not apply where liability cannot lawfully be excluded or limited. Nothing in these Terms limits rights or remedies available to you under applicable consumer-protection law.
21. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.Nothing in this section deprives you of mandatory consumer protections or other rights that apply to you under the laws of your jurisdiction and cannot lawfully be waived.
22. Changes to These Terms
We may update these Terms from time to time as TriedThat develops, our business or practices change, or legal and platform requirements evolve.When we update these Terms, we will update the "Last updated" date at the top of this page.If a change materially affects your rights or obligations, we will provide additional notice where reasonably appropriate or required by applicable law.Your continued use of TriedThat after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law.
23. Entire Agreement and Severability
These Terms, together with the TriedThat Privacy Policy and any additional terms presented to you in connection with a particular feature or purchase, form the agreement between you and Lashachi Inc. regarding your use of TriedThat.If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by applicable law.Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
